Does speaking in another language designated for that server (Chinese, Spanish in English server, English in France server etc. ...) against any rules or term of service ?. If yes, what is the punishment ? and does it included the used of megaphone (for example: recruiting using another language).

As far as I'm aware, no. A lot of people on the NA server speak primarily/only Spanish, and while I don't speak Spanish and therefore can't communicate with them, they have every right to speak it.
Additionally, in the FAQ, it says:

Basically, there are no rules against it, and people from any country (that isn't IP blocked) are allowed to play on any server, so it stands to reason that they'd be allowed to talk their language on the server.
On forum its forbidden.
In the game however, there are alot of none english persons
I believe you can speak what you want if it belong to any country listed in Information regarding region block
That's why client includes cyrillic fonts, for example.
